WHAT IS FOOD LICENSING?
Food licensing refers to the process of obtaining a license or registration from the Food Safety and Standards Authority of India (FSSAI) for the production, distribution, and sale of food products. The FSSAI is the primary regulatory body for food safety in India, and is responsible for enforcing the Food Safety and Standards Act, 2006.
The specific requirements for food licensing in India can vary depending on the type of food business, the location of the business, and the size of the business. However, in general, food licensing is mandatory for all food-related businesses, including manufacturers, wholesalers, retailers, and food service establishments such as restaurants and cafes.
The licensing process in India typically involves submission of an application along with relevant documents such as proof of identity, proof of ownership or lease of the premises, food safety management plan, and other relevant documents. The FSSAI will then conduct an inspection of the food production or storage facilities, and evaluate the quality and safety of the food products, as well as the management and hygiene practices of the business.
Once the application is approved, the FSSAI will issue a license or registration certificate, which is valid for a specific period of time. In addition to the mandatory licensing requirements, food businesses in India are also required to comply with various food safety regulations and standards, such as labeling requirements, maximum residue limits for pesticides and other contaminants, and hygiene and sanitation standards. Failure to comply with the requirements can result in penalties, fines, or legal action.
TYPES OF FOOD LICENSES
There are different types of food licenses that a business may apply for, depending on the nature and scale of the food business. Some of the common types of food licenses in India are:
1. Basic Registration
This is required for small businesses, including food stalls, food distributors, and small-scale food manufacturers with an annual turnover of less than Rs. 12 lakhs. This registration is valid for five years.
2. State License
This license is required for medium-sized food businesses, including manufacturers, wholesalers, and distributors with an annual turnover of between Rs. 12 lakhs and Rs. 20 crores. This license is valid for up to five years.
3. Central License
This license is required for large food businesses, including manufacturers, importers, and exporters with an annual turnover of more than Rs. 20 crores. This license is valid for up to five years.
4. FSSAI CENTRAL LICENSE FOR IMPORT/EXPORT
This license is required for businesses that are involved in the import or export of food products. This license is valid for up to five years.
5. FSSAI REGISTRATION FOR E-COMMERCE
This registration is required for online food businesses that do not have a physical establishment. This registration is valid for up to five years.
DOCUMENTS REQUIRED
> IDENTITY PROOF
This may include PAN card, Aadhaar card, voter ID card, passport, or driver's license.
> proof of ownership or lease of the premises
This may include property tax receipts, lease agreement, or rent receipt.
> food safety management plan
This should include details of the food products to be produced, the processes involved, the source of raw materials, storage and transportation practices, and quality control measures.
> NOC from the local municipality or gram panchayat
This is required to ensure that the food business is complying with local zoning and land use regulations.
> Declaration of food safety management
This is a declaration by the owner or operator of the food business that they will comply with all food safety and hygiene regulations.
> water testing report
This may be required to ensure that the water being used in the food production process is safe and free from contaminants.
> pest control certificate
This may be required to ensure that the food production facilities are free from pests and insects.
> fssai registration fee
This fee varies depending on the type of license or registration being applied for.
